Terms and Conditions for Partner Churches

Section 1 - Agreement to Terms
By registering as a Partner Church or submitting member data through the Rebirth in Christ baptism reminder service (the "Service"), your organization agrees to be bound by these Terms of Use. If your organization does not agree to these Terms, do not use the Service.
Rebirth in Christ ("RIC") reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be communicated to the primary contact email on file.
Section 2 - Eligibility and Authority
The Service is available to churches, religious organizations, and faith-based institutions ("Partner Church"). By registering, you represent that you are authorized to act on behalf of your Partner Church and to bind it to these Terms.
You further represent that your Partner Church is a legitimate religious institution operating in compliance with applicable federal, state, and local laws.
Section 3 - Description of Service
The Service provides annual baptism anniversary reminder cards ("Rebirthday Cards") to church members enrolled by a Partner Church.
Complimentary Offering: Rebirthday Cards are provided to Partner Churches and their enrolled members at no cost. This complimentary offering is limited solely to the delivery of Rebirthday Cards on each enrolled member's baptism anniversary date. No other services, tools, communications, or resources are included in this no-cost offering.
RIC may offer additional services to Partner Churches in the future. Any such services will be governed by separate terms and require separate agreement. Use of the complimentary Rebirthday Card service does not entitle or bind a Partner Church to any additional services.
RIC may modify, suspend, or discontinue any aspect of the Service at any time without prior notice. RIC is not obligated to maintain, support, or update the Service.
Section 4 - Data Controller and Processor Roles
Partner Church is the Data Controller. Your organization determines which member data to collect and submit to the Service, and for what purposes. You are responsible for obtaining appropriate consent from your members before submitting their personal information.
RIC is the Data Processor. RIC processes member data solely on your behalf and according to your instructions to deliver the Service. RIC does not independently decide how to use your members' data and will not sell or otherwise use your member's data without your express written consent.
This allocation of responsibilities follows the standard model used by church management platforms such as Planning Center, Breeze, and ChurchSuite.
Section 5 - Church Obligations for Member Data
As the Data Controller, your organization agrees to:
- Obtain informed consent from members before submitting their personal information to the Service
- Provide members with clear notice about how their data will be used, including that it will be processed by RIC
- Submit only accurate and current member information
- Promptly notify RIC if a member requests deletion of their data
- Update and maintain your membership data, which remains as your property
- Maintain your own records of member consent
- Not submit data for individuals under 13 without verifiable parental consent (COPPA compliance)
Section 6 - Acceptable Use and Intellectual Property
You agree not to use the Service to:
- Submit data for individuals who have not consented to participation
- Use the Service for purposes unrelated to baptism reminders and spiritual growth
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorized access to any part of the Service
- Use the Service for any unlawful purpose or in violation of any applicable laws
Subject to the limited rights expressly granted hereunder, RIC reserves all right, title, and interests in and to the RIC Service and technology, including all intellectual property rights embodied therein, which shall remain the sole and exclusive property of RIC or its licensors. No rights are granted to any Partner Church hereunder other than as expressly set forth herein. Use of the Service does not transfer any ownership interest in the RIC Service or technology and does not transfer from Partner Church to RIC any ownership interest in member data.
User-Submitted Content. To the extent your Partner Church submits any content to the Service beyond standard member-roster fields, including but not limited to custom notes, personalized card messages, church-specific language, or uploaded assets ("Church Content"), your Partner Church represents and warrants that it either owns the Church Content or holds all rights and licenses necessary to submit it and to authorize its use as described here. Your Partner Church grants RIC a limited, non-exclusive, royalty-free, worldwide license to host, store, transmit, format, and display the Church Content solely as necessary to deliver the Service to your enrolled members. This license ends when the Church Content is deleted or when participation in the Service terminates, whichever comes first. RIC does not acquire any ownership of the Church Content, and Partner Church remains responsible for ensuring the Church Content is not unlawful, defamatory, infringing, or otherwise inappropriate.
Section 7 - Bulk Data Submission
When submitting member data in bulk (such as CSV uploads or batch imports), your organization is responsible for ensuring all submitted data is accurate.
RIC will process bulk submissions as received. RIC is not responsible for errors in data submitted by your organization, including duplicate entries, incorrect contact information, or submissions made without proper member consent.
Section 8 - Data Privacy and Handling
Member data submitted through the Service will not be sold, rented, or shared with third parties for marketing purposes.
RIC may share data with third-party service providers (sub-processors) solely as necessary to operate the Service. These providers are contractually required to protect the data. RIC's current sub-processors are:
- SendGrid (Twilio Inc.) - email delivery of rebirthday cards and service notifications.
- Netlify, Inc. - website hosting and web traffic handling.
- Supabase (via ForgeSystems) - database storage and authentication infrastructure.
- Google Fonts - font delivery for page rendering.
- Cloudflare CDN - icon font delivery for page rendering.
RIC will provide Partner Church with at least thirty (30) days advance notice of any material change to this sub-processor list through the email address on file. For the member-facing description of these sub-processors and their purposes, see the Privacy Policy.
Religious Data: Information about baptism, church membership, and spiritual practices is considered sensitive personal data. RIC applies enhanced safeguards to this information in compliance with applicable state privacy laws, including the Texas Data Privacy and Security Act (TDPSA). Under the TDPSA, religious data is classified as sensitive data requiring affirmative consent before processing.
Section 9 - Data Security
RIC implements commercially reasonable security measures to protect member data, including encryption in transit and at rest, access controls, and regular security assessments. However, no method of electronic transmission or storage is completely secure. RIC cannot guarantee absolute security of member data. Your organization acknowledges and accepts this inherent risk.
Section 10 - Data Breach Notification
In the event of a data breach affecting member information, RIC will notify your organization's primary contact without unreasonable delay in accordance with the Texas Identity Theft Enforcement and Protection Act (Tex. Bus. and Com. Code Chapter 521).
Notification will include a description of the breach, the types of information involved, and recommended steps for affected members. Your organization is responsible for notifying affected members as required by applicable law.
Section 11 - Data Retention and Deletion
Member data will be retained for the duration of your organization's participation in the Service. Upon termination, RIC will delete member data within 90 days unless retention is required by law.
Your organization may request deletion of specific member records at any time by contacting legal@rebirthinchrist.com. RIC will process deletion requests within 30 days.
Section 12 - Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
RIC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. RIC DOES NOT WARRANT THE ACCURACY OR TIMELINESS OF REMINDERS OR COMMUNICATIONS DELIVERED THROUGH THE SERVICE.
Section 13 - Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIC'S TOTAL LIABILITY TO YOUR ORGANIZATION FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED FIFTY DOLLARS ($50.00).
IN NO EVENT SHALL RIC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF DONATIONS, LOSS OF MEMBERSHIP, OR REPUTATIONAL HARM, REGARDLESS OF THE THEORY OF LIABILITY.
THIS LIMITATION APPLIES WHETHER THE CLAIM IS BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF RIC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Section 14 - Indemnification
Your organization agrees to indemnify and hold harmless RIC, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your organization's use of the Service
- Your organization's violation of these Terms
- Your organization's failure to obtain proper member consent
- Any claim by a member related to data your organization submitted to the Service
Section 15 - Force Majeure
RIC shall not be liable for any delay or failure to perform its obligations under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, cyberattacks, hacking, malware, ransomware, distributed denial-of-service attacks, or extended infrastructure outages.
Section 16 - Children's Privacy (COPPA)
Your organization must not submit personal information for children under 13 without first obtaining verifiable parental consent in compliance with the Children's Online Privacy Protection Act (COPPA) and 16 CFR §312.5.
If RIC becomes aware that data for a child under 13 has been submitted without proper parental consent, RIC will delete the data and notify your organization.
Application of COPPA to RIC. As a non-profit entity that does not operate for profit, RIC is generally outside the Federal Trade Commission's jurisdiction under Section 5 of the FTC Act (15 U.S.C. §§44-45), and COPPA's definition of "operator" at 15 U.S.C. §6501(2)(B) excludes a non-profit that would otherwise be exempt from Section 5 coverage. Rebirth in Christ is recognized as a 501(c)(3) non-profit in Texas (Taxpayer Number 32104321529); that recognition is strong evidence of, but is not the legal trigger for, the COPPA carve-out. The trigger is FTC Section 5 jurisdiction, not IRS 501(c)(3) status itself. Accordingly, COPPA does not strictly apply to RIC. Nevertheless, as a matter of good practice and to protect children, RIC requires every Partner Church to obtain verifiable parental consent before submitting any data regarding a child under 13, and Partner Churches remain bound by COPPA §312.5 for information they themselves collect directly from children.
Section 17 - CAN-SPAM Compliance
All communications sent through the Service to your members comply with the CAN-SPAM Act. Each message includes clear identification of the sender, a valid physical address, and a functioning unsubscribe mechanism.
Note: The CAN-SPAM Act applies to commercial messages regardless of the sender's nonprofit status. All Service communications are fully compliant.
Section 18 - Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
Any dispute arising from these Terms shall first be attempted to be resolved through good faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Randall County, Texas. Each party bears its own costs.
Section 19 - Termination
Either party may terminate participation in the Service at any time by providing at least 30 days written notice to the other party.
Upon termination, RIC will cease processing member data and delete it within 90 days. Your organization at its cost may request an export of member data prior to termination.
Section 20 - Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between your organization and RIC regarding the Service.
- Survival of Terms: Sections related to limitation of liability, indemnification, and governing law survive termination.
- Severability: If any provision is found unenforceable, the remaining provisions remain in full force and effect.
- Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: Your organization may not assign its rights under these Terms without RIC's written consent.
