Member Terms of Use
For individuals receiving a rebirthday card

Welcome, and thank you for letting us celebrate your rebirth in Christ with you. These Member Terms of Use ("Member Terms") are the agreement between you and Rebirth in Christ ("we," "our," or "us") when you sign up to receive a rebirthday card, either on your own or through your church.
We kept this short and readable on purpose. If something is unclear, email legal@rebirthinchrist.com.
1. Your Agreement to These Terms
By signing up for the Rebirth in Christ service, you agree to these Member Terms. You also agree to them if a Partner Church signs you up with your consent; your Partner Church agrees, under our Church Terms of Use, to obtain that consent before adding you.
If you don't agree to these Member Terms, please don't sign up, and let us know so we can remove your record.
2. What the Service Is
The service is simple: once a year, on the anniversary of your baptism, you receive a personalized rebirthday card by email. That's it. We don't send newsletters, we don't send fundraising appeals, and we don't send anything between anniversaries unless you or your church asks us to update something on your record or we need to reach you about a material change to these terms or the privacy policy.
The service is currently offered free of charge. We reserve the right to change, pause, or discontinue any part of the service at any time. If we ever introduce a paid tier, the free annual rebirthday card you signed up for will remain free.
3. Your Data
We handle your personal information in line with our Privacy Policy, which describes exactly what we collect, who helps us deliver the service, how long we keep your information, and the rights you have to access, correct, or delete it. Please read it alongside these Member Terms.
4. Unsubscribing
You can stop receiving emails at any time. Every email we send has a clear unsubscribe link in the footer, and you can also unsubscribe directly at rebirthinchrist.com/unsubscribe. Once you unsubscribe, we will stop sending you cards and will handle your record as described in the Privacy Policy.
5. Acceptable Use
When you use our website or service, please don't:
- Sign up someone else without their consent, or use a name or email that isn't yours.
- Send spam through any of our forms or contact channels.
- Scrape, reverse-engineer, or try to gain unauthorized access to any part of the service or its infrastructure.
- Impersonate another person, a church, or Rebirth in Christ itself.
- Use the service to harass, threaten, or defraud anyone.
- Use the service for any purpose that is unlawful under federal, state, or local law.
6. Ownership
Rebirth in Christ owns the website, the card designs, the name and logo, and the underlying platform. You keep ownership of your personal information. Nothing in these Member Terms transfers your data to us as property; we are simply stewards of it for as long as you remain enrolled in the service.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT EMAILS WILL ARRIVE ON TIME OR AT ALL. DELIVERY DEPENDS ON YOUR EMAIL PROVIDER, YOUR FILTERS, AND THE WIDER INTERNET, ALL OF WHICH ARE BEYOND OUR CONTROL.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE, THESE MEMBER TERMS, OR THE PRIVACY POLICY SHALL NOT EXCEED THE GREATER OF (a) ONE HUNDRED DOLLARS ($100.00) OR (b) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. BECAUSE THE SERVICE IS CURRENTLY FREE, (b) WILL TYPICALLY BE ZERO, AND THE EFFECTIVE CAP WILL BE $100.
IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, EMOTIONAL DISTRESS, OR REPUTATIONAL HARM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY OF THE CLAIM (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE). SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN THOSE STATES, OUR LIABILITY IS LIMITED TO THE SMALLEST AMOUNT PERMITTED BY LAW.
9. Governing Law and Venue
These Member Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any court proceeding that is not subject to arbitration under Section 10 shall be brought in the state or federal courts located in Randall County, Texas. You and we consent to the jurisdiction of those courts.
10. Dispute Resolution and Arbitration
We hope any disagreement can be resolved through a short email exchange. If it cannot, the parties agree to the following process:
Informal resolution. Before filing any formal claim, you and we agree to try to resolve the dispute by good-faith negotiation for at least 30 days after written notice of the dispute has been sent to legal@rebirthinchrist.com.
Binding arbitration. If the dispute is not resolved through informal negotiation, it shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in Randall County, Texas, unless you and we agree otherwise. Judgment on the arbitrator's award may be entered in any court with jurisdiction. You may also bring an individual claim in small-claims court if it qualifies.
Class-action waiver. You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any class or representative action.
Opt-out. You may opt out of this arbitration agreement by sending a written notice to legal@rebirthinchrist.com within 30 days of first accepting these Member Terms. Your opt-out notice must include your name, the email address on your record, and a clear statement that you are opting out of the arbitration clause. If you opt out, disputes will instead be resolved in the courts named in Section 9.

12. Miscellaneous
- Changes: We may update these Member Terms. If we make material changes, we will update the "Last Updated" date above and, where we have your email, send you a notice at least 14 days before the change takes effect. Your continued use of the service after the effective date means you accept the updated terms.
- Survival: Sections 7 (Disclaimer), 8 (Limitation of Liability), 9 (Governing Law and Venue), and 10 (Dispute Resolution) survive any termination of your use of the service.
- Severability: If any part of these Member Terms is held unenforceable, the rest remains in effect.
- No waiver: Our failure to enforce any part of these Member Terms is not a waiver of our right to enforce it later.
- Entire agreement: These Member Terms, together with the Privacy Policy, are the entire agreement between you and Rebirth in Christ about the service, and supersede any prior discussions.
